Terms of Service

These terms govern your access to and use of OsmiumStack, the Iridium hosting add-on, and related services.

This is a sample agreement provided with the OsmiumStack starter. It is not legal advice — have your own counsel review and adapt it before relying on it in production.

1. Agreement to terms

By creating an account, accessing, or using OsmiumStack (the "Service"), you agree to be bound by these Terms of Service (the "Terms") and by our Privacy Policy. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

2. The Service

OsmiumStack provides agency project-management, billing, and client-preview tooling. The Iridium add-on provides Kubernetes-native hosting for environments you provision. We may add, change, or remove features over time, and we will give reasonable notice of material changes that adversely affect your use.

3. Accounts and organizations

An OsmiumStack workspace is owned by an organization. You are responsible for the activity of members you invite, for keeping credentials secure, and for ensuring members comply with these Terms. Notify us promptly at [email protected] if you suspect unauthorized access.

4. Acceptable use

You agree not to, and not to permit others to:

  • use the Service to violate any law or infringe the rights of others;
  • upload malware, attempt to breach security, or probe systems without authorization;
  • resell or provide the Service to third parties except as expressly permitted;
  • use Iridium to run workloads that endanger the stability of shared infrastructure.

5. Customer content

You retain all rights to the content you and your clients submit ("Customer Content"). You grant us a limited license to host, process, and transmit Customer Content solely to provide and improve the Service. You are responsible for having the rights necessary to submit it.

6. Fees and billing

Paid plans are billed per active member per month in advance and are non-refundable except where required by law. Iridium usage beyond plan allowances may incur additional charges. We may change pricing with at least 30 days' notice before your next renewal.

7. Trials

Free trials are provided as-is and may be modified or discontinued at any time. Unless you purchase a plan before the trial ends, your workspace will be paused, not deleted.

8. Termination

You may cancel at any time from your workspace settings. We may suspend or terminate access if you materially breach these Terms or create risk for the Service or other customers. On termination you may export your data for 30 days, after which it may be deleted.

9. Warranties and disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages. Our aggregate liability arising out of these Terms will not exceed the amounts you paid us in the 12 months before the event giving rise to the claim.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes we will notify you by email or in-product. Continued use after changes take effect constitutes acceptance.
